What is DUI / DWI & OVI?

Currently in Ohio we refer to the offense of driving under the influence as OVI, or Operating a Vehicle while Under the Influence. In the past it has been referred to as DWI (Driving While Intoxicated), DUI (Driving Under the Influence), OMVI (Operating a Motor Vehicle while under the Influence). and other various terms. They are all the same, OVI is just the relevant term of art for the day.

Driving under the influence of drugs or alcohol is a criminal offense. If you are found guilty of driving under the influence, you may be handed down the judgment of jail time, a steep fine, your license suspended or possibly probation. It will also go on your permanent record and can cause you to lose your job or keep you from being selected for a job.

Some of the visual signs of an individual driving while under the influence of drugs or alcohol are driving too slow or too fast. The inability to keep the vehicle straight on the road is another sign. Also if you ignore stop signs or lights or do not use your signals before turning this can be evidence that you are not thinking clearly. If you are pulled over for any of these reasons, the police will look for further signs of intoxication. A DUI attorney may advise you to refuse taking any of these roadside tests.

If you are placed under arrest for DUI, you will most likely be expected to take a chemical BAC test. This stands for Blood Alcohol Content and you will be asked for a breath sample if you are suspected of alcohol consumption and urine or a blood sample if drugs are suspected. No matter what state you are in a blood alcohol of or exceeding 0.08 in Ohio is per se intoxication.
